Amazon Seller Insurance for Sellers in France

French beauty, home and fashion brands reach US customers through Amazon.com. This guide covers the territory gap in French liability contracts, the FDA questions cosmetics raise, and the file we need to quote.

The “Monde entier” clause and its US carve-out

Every French RC Pro or RC produits contract defines where it applies, a clause French insurers call territorialité. A policy sold as “Monde entier” sounds like it reaches every market, yet French comparison guides warn that many of these contracts leave out the United States and Canada, and that a seller working there should check the contract and plan for a local policy.

When a French insurer does add North America, the extension usually comes with its own premium, a higher deductible and limits in euros. Amazon reviews something narrower: a certificate in English, limits of $1 million per occurrence and in the aggregate, Amazon named as additional insured by endorsement, and an insurer rated A- or better. A French contract rarely produces that document without a lot of back and forth.

The practical answer for a French seller is two policies side by side. The French contract stays in place for sales in France and the rest of Europe, and a US product liability policy answers Amazon.com. We place that US policy for companies based in France, in the company’s own name.

Amazon.com’s insurance rule for a French company

The trigger is your Amazon.com revenue, wherever your company is registered. Once gross proceeds on Amazon.com pass $10,000 in a single month, Amazon gives you 30 days to upload proof of commercial liability insurance, and it can ask sooner. Sales on amazon.fr and the other European stores do not count toward that figure.

The change that matters most for French brands arrives on November 2, 2026. Amazon’s September notice, as reported by trade press, says listings in enhanced-safety categories need the policy whatever their sales, and cosmetics sit on that list next to children’s products, ingestibles and lithium-battery goods. A Lyon skincare brand testing the US market with a handful of SKUs now needs cover before launch. Our Amazon seller insurance requirements page sets out every point Amazon checks, and you should confirm the deductible limit in Seller Central before you choose one.

Cosmetics and fragrance: the FDA questions underwriters ask

A French beauty brand already keeps an EU safety assessment and product file for each formula. US underwriters ask a parallel set of questions under the Modernization of Cosmetics Regulation Act, known as MoCRA. The responsible person registers the manufacturing facility with FDA and lists each product, and US labels carry a domestic address, phone number or electronic contact for adverse event reports.

Claims change the risk as well. FDA decides whether a product is a cosmetic or a drug by its intended use, so a moisturizer sold with a sun-protection claim or a cleanser sold to treat acne is regulated as a drug in the US. Underwriters read your Amazon listings for those words, so fix any mismatch between the label and the listing before you apply.

Have ready the full ingredient list, your adverse event log, the US label artwork and the name of the US responsible person. Very small brands below the MoCRA small-business threshold are exempt from registration and listing, and it helps to say so up front. Our cosmetics and beauty guide goes deeper on the category.

Documents from a French company

Underwriters ask for a recent Kbis extract, your SIREN number, Amazon.com sales for the last twelve months, the product list with ASINs and the factories behind each line. The named insured must match your seller account exactly, legal form included, so “Maison Exemple SAS” and “Maison Exemple SARL” are two different names to Amazon. Accents count too: decide whether the account reads “Société” or “Societe” and use the same spelling on the policy.

Tell us how goods reach the US: Amazon Global Logistics, your own forwarder or a US prep center. The route shapes who acts as importer of record and which companies the policy lists. Keep your home insurer in the loop as well, because the revised EU Product Liability Directive applies from 9 December 2026 and widens who can face claims in Europe, including fulfilment service providers when no EU manufacturer or importer is available.

Timing your renewal from Paris

Paris runs six hours ahead of New York and nine ahead of Seattle. A certificate request that arrives late in the US day lands in your inbox overnight, and the clock Amazon sets starts on its side of the Atlantic, not yours.

Plan the US renewal for a month when your team is at full strength. Many French companies slow down in August, and a policy that expires mid-August leaves nobody to upload the new certificate. We send renewal paperwork early and keep the endorsement with the certificate, so one person can finish the upload in a few minutes.

Keep a dated copy of every certificate you upload. If Amazon questions the policy months later, that copy shows exactly what was on file and when, and it saves a search through old emails.

How Mithril1 helps French sellers

We work with hundreds of Amazon sellers, including beauty and home brands that started in Europe. For French companies we place US product liability that matches Amazon’s requirement, walk through the certificate line by line, and keep the cosmetics questions in plain English.

Send your Kbis, product list and Amazon.com sales through our contact page to start a quote. The Amazon seller insurance hub lists every guide in this series, including the international sellers overview and the certificate guide.

A few useful answers

Common questions

Does a French RC Pro contract cover sales on Amazon.com?

Only if the territory clause names the United States and the contract also meets Amazon’s endorsement, limit and insurer-rating points. Many “Monde entier” contracts leave the US out, so French sellers usually add a US policy for Amazon.com.

Do I need MoCRA registration before you can quote my cosmetics?

Not always. We ask for your facility registration and product listing numbers if you have them. If your brand is below the MoCRA small-business threshold, tell us, and we quote on your formulas, labels and adverse event history.

Can the US policy name my French SAS?

Yes. We place US product liability for companies based in France, with the French company as named insured, spelled exactly as it appears on the Amazon seller account.

My company is French but my products are made in China. Does the Accelerator rule apply?

No. The November 2026 Accelerator rule follows where the seller is based, and it reaches sellers based in Mainland China. A French company can place its US policy through us, and underwriters ask about the factories and their test reports as part of the quote.

Do sales on amazon.fr count toward Amazon's US threshold?

No. The $10,000 monthly figure counts gross proceeds on Amazon.com only. The November 2026 category rule applies to US listings in those categories whatever their sales.

Other French categories underwriters look at

Scented candles and home fragrance raise fire questions: wick tests, warning labels in English, and how the jar behaves when the candle burns low. Enamelled cookware, kitchen textiles and table linens carry fewer injury scenarios, though the policy still has to be in place once sales pass Amazon’s threshold.

Baby and nursery goods from French brands fall under Amazon’s children’s products rule from November 2026, and US standards for cribs, teethers and toys differ from European ones. If any of your products are for children under 12, read the children’s products guide on our Amazon hub before you apply.

Fashion accessories, leather goods and stationery sit at the quieter end of product liability. Underwriters still ask about small parts, metal hardware such as buckles and clasps, and dyes that touch skin, and a short note on where each item is made and tested answers most of those questions.
