Amazon Seller Insurance for Sellers in Spain
Selling on Amazon.com from Spain? Here is where a Spanish liability policy stops, how Amazon’s US rule applies to an SL or an autónomo, and what we need to quote US cover.
Ámbito territorial: where a Spanish policy stops
Spanish liability policies set their reach in a clause headed ámbito territorial. The usual versions are the European Union, the whole world, or the whole world except the USA and Canada, and Spanish insurers tend to add the USA and Canada only on express request, and sparingly.
A second line in the same clause often matters more. Many wordings pay only for claims brought before, or recognized by, Spanish courts. The brokerage warns that this leaves a worldwide clause with little practical effect, because the insurer would neither defend nor pay a judgment from a foreign court. On Amazon.com, where an injured customer sues at home in the US, that line decides the question.
Read both lines in your RC productos or RC general policy before relying on it for US sales. Many Spanish sellers keep the Spanish policy for Spain and the rest of Europe and add a US policy for Amazon.com, so each one answers the courts it was written for. We request US product liability for sellers based in Spain, whether the seller is a company or a sole trader, and the insurer decides after reviewing the file.
Amazon.com’s rule for a Spanish seller
A Spanish SL that sells on amazon.es and Amazon.com answers to the US store’s rule for its US sales. Once gross proceeds on Amazon.com pass $10,000 in a month, or when Amazon asks, the seller has 30 days to show commercial liability insurance with at least $1 million per occurrence and in the aggregate, Amazon added as additional insured by endorsement, and an insurer rated A- or better.
The US is now a regular destination for Spanish SMEs. Amazon reported in October 2024 that the five countries they export to most are France, Germany, Italy, the United States and the United Kingdom, and in October 2025 that their exports passed €1.2 billion in 2024. Our Amazon seller insurance requirements page goes through each point Amazon checks, and our product liability insurance page explains the cover itself.
If your Spanish policy carries a franquicia, remember that the US policy sets its own deductible in US dollars. Check the current deductible rule in Seller Central before you bind, and tell us the figure your business can carry.
Toys, children’s shoes and the November 2026 rule
Amazon’s 2024 report named home, health and personal care, toys, beauty and office supplies as the categories international customers buy most from Spanish SMEs, and its 2025 release featured Pisamonas, a family company making children’s footwear. Toys and children’s shoes both fall in the children’s products category that, from November 2, 2026, needs the $1 million policy at any sales level.
For those lines a US underwriter asks for US evidence beside the European file. Toys for children 12 and under need third-party testing to ASTM F963-23, the mandatory US toy standard, at a CPSC-accepted laboratory, and a Children’s Product Certificate that lists the sections certified. For goods made abroad, the importer issues that certificate. EN 71 reports show a careful maker, but they answer European rules, not American ones. Our children’s products guide lists what to gather.
Beauty and personal care lines bring FDA labeling questions instead, and ingestibles such as olive oil capsules or herbal teas sit in the enhanced-safety list as well. Compare every ASIN with the category list in Seller Central, because the rule reaches live listings, not just new ones.
Footwear, home goods and anything with a plug
Spanish footwear brands are a common case. Adult shoes carry modest injury exposure, yet underwriters still ask about soles and materials, the care labels, and any returns pattern that points to a defect rather than a sizing problem.
Home goods lead Amazon’s list for Spanish sellers, and most are low-hazard: kitchen textiles, ceramics, storage. The conversation changes for anything with a plug or a battery. A hair styler or kitchen gadget designed for Spain’s 230-volt supply needs a US version, and underwriters ask for the North American safety listing on the exact model you ship to FBA.
Paperwork from a Spanish company
The named insured has to match Account Info character for character, legal form included. “Sociedad Limitada”, “S.L.” and “SL” read as three different spellings to a reviewer, so copy the name exactly as the account shows it. For an autónomo selling under a trade name, the policy names the owner personally, with the trade name listed after it.
For the application we ask for a recent nota simple from the Registro Mercantil, which shows the company’s name, NIF and registered address, plus Amazon.com sales for the last twelve months, the product list with ASINs, where each line is made, and your claims history. If goods made in a third country ship straight to FBA without passing through Spain, say so, since the route changes who acts as importer of record and who the policy should list.
From the peninsula and the Canary Islands
Peninsular Spain and the Balearics run on Central European Time, nine hours ahead of the US Pacific coast for most of the year. The Canary Islands keep Western European Time, an hour behind Madrid, so a seller in Las Palmas sits eight hours ahead of Seattle. Both change clocks on the last Sundays of March and October, a week before most of the US does in autumn.
We work with hundreds of Amazon sellers, and Spanish brands usually reach us with the same deadline problem: Amazon’s request arrived on US time, after the team in Valencia or Barcelona had gone home. We ask for everything in a single message and send the policy, endorsement and certificate back as one set, ready to upload. Guides on FBA, certificates and product categories are collected on our Amazon seller insurance hub.
A few useful answers
Common questions
Does a Spanish RC productos policy cover my Amazon.com sales?
Only when its ámbito territorial includes the USA and Canada and the policy accepts claims outside Spanish courts. It then still has to carry Amazon’s endorsement and meet the limit and insurer-rating points.
Can an autónomo buy US product liability through Mithril1?
It can, when the insurer accepts the products and the sales record. We request US product liability for sole traders and companies based in Spain, with the insured name matching the seller account exactly.
Do children's shoes need insurance before $10,000 a month in sales?
From November 2, 2026, children’s products sit in Amazon’s enhanced-safety categories, which need the $1 million policy at any sales level. Match each listing to the current category list in Seller Central.
Are EN 71 test reports enough for a US quote on toys?
They help, but underwriters ask for testing to ASTM F963-23 at a CPSC-accepted laboratory and a Children’s Product Certificate, which the importer issues for toys made abroad.
Does a seller in the Canary Islands face a different insurance rule?
The rule is the same for every seller on Amazon.com. What differs is the clock: the Canaries sit an hour behind the peninsula, so Amazon’s US-time requests arrive slightly earlier in your day.
