Insurance for Jewelry Brands and Importers Selling on Amazon

Fashion and fine jewelry look low risk until a lab finds lead or a child swallows a magnet. Here is how liability reaches jewelry brands that sell on Amazon and what underwriters ask before they quote.

Why jewelry brands carry the product liability

Most jewelry on Amazon is made overseas and sold under a US brand. The brand owner who imports it, or who buys it from a factory under its own label, is the business an injured customer can actually find. Texas law shows how this plays out: a seller that did not make a product generally avoids liability for it, but one exception applies when the manufacturer is insolvent or beyond the jurisdiction of the court, which describes many small overseas jewelry workshops.

Designers who send their own sketches and metal specifications to a factory carry an extra layer, since a design that turns out to be unsafe is theirs. Our guide to private label and importer liability explains the wider picture, including the duties of the importer of record at customs.

Resellers who buy finished pieces from a US distributor sit further back in the chain, though a claim can still reach them when the distributor cannot pay.

What goes wrong with jewelry

Jewelry claims are smaller than candle or appliance claims, but they arrive in steady numbers. The usual ones are skin reactions to nickel and other base metals, cuts from sharp edges or broken clasps, earring posts and body jewelry linked to infections, and choking or swallowing when small pieces reach young children.

Two hazards deserve their own attention. Small loose magnets can join inside the gut if swallowed, and the CPSC’s magnet rule at 16 CFR part 1262 reaches jewelry, children’s jewelry included, that contains loose or separable magnets; any magnet small enough to fit the small parts cylinder must stay under the rule’s flux index limit. Watches and light-up pieces powered by button or coin batteries fall under Reese’s Law, which calls for secure battery compartments and warnings on the product and its packaging.

Fine jewelry adds a quality layer. Amazon gates fine jewelry behind an approval process and its own quality assurance standards, and listings that misstate karat, metal or stone type draw complaints a product liability policy is not built for. Describe each piece the way the FTC’s Jewelry Guides expect, with a word such as laboratory-grown placed directly before “diamond” for lab stones.

Lead, cadmium and children’s jewelry

No mandatory federal safety rule is aimed at adult jewelry as a class; the CPSC points to ASTM F2999 for adult pieces and ASTM F2923 for children’s jewelry as voluntary best practice. Children’s jewelry is a different matter. Anything designed or intended primarily for children 12 and under is a children’s product, so it must meet the 100 ppm total lead limit and the 90 ppm limit for lead in paint and surface coatings, with testing at a CPSC-accepted third-party lab, tracking labels and a Children’s Product Certificate.

California goes further. Its jewelry law bars children’s jewelry with any component above 0.03 percent cadmium by weight, or with a surface coating above 0.0075 percent soluble cadmium. Proposition 65 adds a warning duty for listed chemicals such as lead and cadmium for businesses with ten or more employees, and private enforcers send 60-day notices to sellers whose products reach California shoppers, with civil penalties of up to $2,500 per day for each violation. Lead is the chemical named most often in those notices, according to Intertek’s monthly analyses.

Whether a piece counts as children’s jewelry turns on its design, marketing and price, not just the size on the tag. Pastel charm bracelets, cartoon pendants and the word kids in a title all point toward a children’s product, whatever the listing category says.

Amazon’s November 2026 rule and jewelry

Amazon’s September 2026 notice names children’s products among the categories that need a $1 million liability policy from November 2, 2026, regardless of sales. Children’s jewelry belongs to that group, so a brand with even one children’s jewelry ASIN needs its policy in place. Adult fashion and fine jewelry are not named in the notice, and for those listings the long-standing rule applies: proof of insurance within 30 days after gross proceeds pass $10,000 in a month, or on Amazon’s request.

Either way, the policy terms do not change. Our Amazon insurance requirements page explains the limits, the additional insured endorsement, the insurer rating and how the certificate is uploaded.

Recalls in the jewelry trade

Many US jewelry recalls have involved children’s pieces that tested high for lead or cadmium, and the remedy is usually a refund and destruction of stock. A recall pulls every unit out of FBA, refunds every buyer and leaves the brand paying for disposal and notices. A standard liability policy leaves out the cost of withdrawing your own product, and our guide to product recall insurance explains the separate cover.

Lot control matters more than most jewelry sellers expect. Keep the alloy and plating specification for each production lot, mark the lots, and test each new lot rather than relying on a report from an earlier order. Factories change base-metal suppliers without notice, and one lower-priced lot can carry lead the first one did not.

What to send for a jewelry quote

Across the hundreds of Amazon sellers we work with, jewelry brands are often surprised by how short underwriting becomes when the paperwork is ready. Bring your product list split into fine, fashion, children’s and body jewelry, with metals, platings, stones and any magnets or batteries noted.

Add lab reports for lead, cadmium and nickel release, Children’s Product Certificates for kids’ lines, the factories and countries of origin, annual sales by channel and line, the legal entity on Seller Central, and any past complaints, returns for skin reactions or Prop 65 notices. Then we compare options with you and check the Amazon endorsement before the certificate goes up. Our Amazon seller insurance hub gathers the other category guides.

A few useful answers

Common questions

Does Amazon's November 2026 insurance rule reach fashion jewelry?

Adult fashion jewelry is not named in Amazon’s notice. Children’s jewelry is, because it is a children’s product. Check each ASIN’s classification in Seller Central, since Amazon decides which group a listing falls in.

Does product liability insurance respond to a Prop 65 notice?

Prop 65 notices seek warnings and civil penalties rather than damages for an injury, and product liability forms are written for injury and property damage. Raise Prop 65 when you compare quotes, and test for lead and cadmium so a notice has nothing to find.

Does adult jewelry need third-party testing?

Federal law requires third-party testing for children’s jewelry, not adult pieces. Testing adult jewelry to ASTM F2999 is still the strongest evidence you can give an underwriter or a court.

Are magnetic bracelets and earrings regulated?

Jewelry with loose or separable magnets falls under the CPSC’s magnet rule, 16 CFR part 1262. Any magnet small enough to fit the small parts cylinder must stay below the rule’s flux index limit.

Is a nickel allergy complaint a product liability claim?

Yes. A rash or infection caused by a piece of jewelry is bodily injury from a product, which is the kind of loss product liability insurance is written for. Keep nickel release results for anything sold as nickel-free.
