Insurance for Appraisers
An appraisal is a signed opinion of value that a lender lends against, a borrower buys on and, for donated property, the IRS reads. We request appraiser insurance for California real estate and personal property appraisers, starting with errors and omissions, and an insurer decides after reviewing your license level, assignments and claims history.
Appraiser insurance starts with who relies on your number
Peter Christensen, general counsel of LIA Administrators, an appraiser E&O program, described three main sources of claims at a 2011 seminar reported by the New England Real Estate Journal. Lenders usually allege overvaluation, often after a borrower defaults and the property sells for less than the appraised value. Borrowers usually say the appraiser failed to find and disclose defects in roofs, sewer or septic lines, foundations, plumbing, electrical systems or termite damage, with mold then an emerging issue. Sellers claim that an undervaluation cost them a sale.
His loss-prevention advice holds up: report a claim to your insurer right away, never admit liability or refund a fee without counsel, state in the scope of work that the report is an appraisal and not a home inspection, and photograph and document the conditions you observe.
BREA license levels and the assignments you accept
Business and Professions Code 11320 bars anyone from engaging in federally related real estate appraisal activity, or using a licensed-appraiser title, in California without an active license; a willful violation is a public offense punishable by jail or a fine of up to $10,000. The Bureau of Real Estate Appraisers sets four levels:
- Trainee (AT): any property the supervising appraiser is qualified to appraise
- Residential (AL): non-complex one-to-four-unit residential up to $1 million in transaction value, complex one-to-four-unit up to $400,000 and non-residential up to $250,000
- Certified Residential (AR): any one-to-four-unit residential property regardless of value or complexity, plus non-residential up to $250,000
- Certified General (AG): all real estate regardless of value or complexity
Your E&O application asks for your level and the property types you appraise, so keep assignments inside it. A licensed appraiser doing an appraisal also may not do home inspection work on the same job under section 7196.1(c); home inspectors carry a different kind of risk and buy a different policy.
Independence rules and the appraisal bias notice
Civil Code 1090.5 forbids anyone with an interest in a real estate transaction from improperly influencing a valuation through coercion, extortion, bribery, intimidation, compensation or instruction. Asking for a preliminary value before hiring, tying the hire or the fee to the value, and supplying a target number are all examples. A real estate agent’s pay rides on the deal closing; yours legally cannot ride on the value.
For sales contracts after July 1, 2022, Civil Code 1102.6g requires a notice that appraisals must be unbiased and not influenced by protected characteristics such as race, religion, gender, source of income, disability and age, and that buyers and sellers can report suspected bias to the lender and file a complaint with BREA. A Bureau complaint can reach you with no lawsuit attached, and answering it takes counsel and time, which is why disciplinary-proceeding coverage belongs on your comparison list.
Reading an appraiser E&O policy
Appraiser E&O answers claims that your opinion of value, or the report behind it, was wrong. It is usually written claims-made, with retroactive coverage for appraisers who stay continuously insured, so a complaint about a report from three years ago goes to the policy in force when the complaint arrives. Keep coverage unbroken when you switch insurers, and ask about an extended reporting period before you stop appraising; our claims-made guide explains why the timing matters.
Compare the extras line by line. Berxi, a Berkshire Hathaway Specialty Insurance brand, lists limits up to $1 million per claim and $2 million aggregate, disciplinary proceeding reimbursement of up to $25,000 per policy period and $1,000 per day for depositions and trials. Some appraiser policies exclude suits by lenders, the FDIC or regulators, so ask whether a quote does. Lenders and appraisal management companies often ask for proof of E&O before they send assignments, so keep a current certificate ready.
Berxi also says its appraiser E&O starts at about $800 a year, moving with location, experience, appraisal revenue and claims. That is one provider’s published starting figure, not a median or a Mithril1 quote; an office with more appraisal revenue or a past claim should expect more, and the insurer sets the price after reviewing the application.
Art, jewelry and equipment appraisers
Personal property appraisers are not licensed by BREA, but donation work brings federal rules. The IRS Form 8283 instructions, revised December 2025, require a qualified appraisal for donated property over $5,000; art of $20,000 or more needs the signed appraisal attached, and deductions over $500,000 generally do as well. The appraisal must be signed no more than 60 days before the contribution and follow the substance and principles of USPAP. A qualified appraiser holds a recognized designation for the property type, or has relevant coursework and at least 2 years of experience valuing it, appraises regularly for pay, includes a declaration of qualifications and cannot set the fee as a percentage of value.
Under 26 U.S.C. 6695A, an appraiser whose work leads to a substantial or gross valuation misstatement on a return owes a penalty of the lesser of two amounts: the greater of 10% of the underpayment or $1,000, or 125% of the gross income from the appraisal. No penalty applies if the value was more likely than not the proper value. Estate and insurance-scheduling values bring client disputes too, and a client’s ring or painting left at your office can be lost or damaged, so we ask insurers how their E&O treats tax-related claims and whether a property or inland marine policy can extend to clients’ items in your care.
Site visits, the drive and the office
General liability, or a business owner’s policy that pairs it with office contents, covers injuries and property damage during inspections and at your office. Driving to inspections in your own car leaves a business liability gap that hired and non-owned auto fills; a company car belongs on commercial auto. Reports carry borrower names, loan details and financial data, and Insureon recommends cyber insurance for appraisers handling sensitive information.
For staff, the WCIRB 8720 footnote sends property appraisal on a fee basis, alone or with clerical work, to code 8742, outside salespersons, whose pure premium rate is $0.337 per $100 of payroll from September 1, 2026, an advisory benchmark rather than an insurer’s price. Office-only staff fall under 8810, and boat appraisal and marine cargo surveys under 7248. Our code 8742 page covers how the code is applied.
A few useful answers
Common questions
Do California appraisers need E&O insurance?
Lenders and appraisal management companies often require proof of E&O before they send assignments. Send us the panel’s requirement and we request a policy at the limit it names, with general liability alongside if your office needs it.
Does appraiser insurance pay to defend a BREA complaint?
Some policies include disciplinary proceeding reimbursement; Berxi lists up to $25,000 per policy period. Check that sub-limit when you compare quotes, since the Civil Code 1102.6g notice tells buyers and sellers how to file a bias complaint.
What happens to my appraiser E&O when I stop working?
A claims-made policy stops answering when it ends, so a claim over an old report needs an extended reporting period arranged before you cancel. Raise it with your insurer a few months before you retire.
Which license level covers a $1.2 million single-family appraisal?
Certified Residential (AR) or Certified General (AG). A Residential (AL) license stops at $1 million for non-complex one-to-four-unit homes. Confirm the scope with BREA before you accept the order.
Can a solo appraiser get appraiser insurance through Mithril1?
It can, once an insurer accepts your application after reviewing your license level, property types, revenue and prior claims. We request E&O first, then general liability and cyber where your office needs them.
