Amazon Seller Insurance for Brazil-Based Sellers
Selling from Brazil to shoppers on Amazon.com? Here is how Amazon’s US insurance rule applies to a Brazilian company, what to ask about your RC produtos policy, and how we look for US cover.
From Amazon.com.br to the US store
Amazon’s Global Selling page for Latin American sellers points Brazilian businesses toward a unified North America and Brazil Professional account, one registration covering the United States, Canada, Mexico and Brazil. A seller that started on Amazon.com.br can instead add the US store later from the Americas tab of its Sell Globally dashboard. Either way, Amazon asks for ID, the business registration, proof of address, tax details, an internationally chargeable card, a bank account and a photo or video identity check.
Amazon’s export program is open to every Amazon Brazil selling partner whose products meet US product rules, and in December 2024 Sebrae’s Paraná office put the number already exporting to the US at about 3,000 of Amazon’s roughly 78,000 sellers in Brazil.
A seller whose Amazon.com gross proceeds pass $10,000 in a month (Amazon’s trigger as of 2026) has 30 days to show commercial liability cover of at least $1 million per occurrence and in aggregate, with Amazon added as additional insured by endorsement. Each of those terms is explained on our Amazon seller insurance requirements page.
Reading an RC produtos policy with US claims in mind
Brazilian product liability is sold as seguro de responsabilidade civil produtos. One Brazilian insurer’s published special conditions for this cover, for example, describe protection for products sold in Brazil, with other countries added only when the policy names them, and they exclude damages imposed as punitive or exemplary in every case.
That exclusion deserves attention, because American product suits can seek punitive damages on top of medical bills and lost wages. So ask your corretor three things: does the territory reach the United States, is that extension written into the policy, and how does the wording treat a US court judgment?
Amazon then checks three details a Brazilian schedule may not show: a limit in US dollars, Amazon’s own additional insured wording, and an insurer rated A- or better by S&P or AM Best. One clean answer is to keep the Brazilian policy for buyers in Brazil and add a separate US policy for Amazon.com sales. We request that US cover for Brazilian sellers, and the insurer decides after reviewing the products and sales. See product liability insurance for how that cover works.
Cosmetics, coffee and the November 2026 change
No official list ranks what Brazilian sellers send to Amazon.com, but the examples Brazilian sources give lean toward beauty and food. When the export program opened, Amazon pointed to a cosmetics house and a specialty coffee seller among its early exporters, and Sebrae’s own case study is a São Paulo sustainable-cosmetics brand earning about 10% of its revenue abroad.
In the US, cosmetics now fall under MoCRA. Manufacturers and processors register their facilities with the FDA and renew every two years, while the responsible person named on the label lists each product with its ingredients, keeps records supporting its safety, and reports serious adverse events within 15 business days. From November 2, 2026, cosmetic and ingestible products also sit in Amazon’s enhanced-safety categories, which need the $1 million policy at any sales level. Our cosmetics and beauty guide covers that category.
Coffee and other foods follow the FDA’s food facility rules: a facility that manufactures, processes, packs or holds food for US consumption registers with the FDA and renews every other year, and the FDA must receive prior notice of each imported shipment. Toys and baby goods need a Children’s Product Certificate based on testing by a CPSC-accepted laboratory, issued by the importer when the goods are made abroad.
RADAR, Siscomex and the US importer
Before a Brazilian company can export through Siscomex, the federal foreign-trade system, it must be enabled with Receita Federal, the habilitação most people call RADAR. Your despachante or contador handles it; we ask only because it shows which company ships the goods.
On the US side, Amazon does not act as importer of record, so another party must. That party appears on the customs entry and shares in the product liability exposure, so tell us whether a forwarder, a US customs broker arrangement or your own US company imports the stock.
The Brazilian company or a US entity as named insured
Amazon’s Latin America-to-US page says a business from the region may not need a US entity or a US bank account at all. If the Brazilian Ltda. or S.A. holds the Amazon.com account, it is the named insured on the policy. If you form a US company to hold the account and import the stock, the policy is written in the US company’s name, and the Brazilian parent can be listed too where the insurer agrees.
Whatever the structure, the legal name on the certificate has to match Seller Central exactly. A brand name on the certificate and the razão social in the account is a mismatch Amazon can reject. We request cover under either structure, and the insurer decides after its review.
Tax sits with your contador. Brazil does not appear on the IRS list of US income tax treaties, and a foreign company documents its US withholding status on Form W-8BEN-E, which Amazon’s tax interview collects. Trade reports of Amazon’s notice also say the Insurance Accelerator requirement from November 2, 2026 covers sellers based in Mainland China only, so a Brazilian seller keeps its choice of insurer.
Four or five hours ahead of California
Decree 9,772 of April 2019 ended daylight saving time across Brazil, so Brasília time, which São Paulo uses, stays at UTC-3 all year. São Paulo is five hours ahead of the US Pacific coast in the northern winter and four hours ahead once US clocks spring forward. A São Paulo afternoon lines up with a West Coast morning.
For a US quote we look for the company’s legal name and address exactly as Seller Central shows them, Amazon.com sales to date and expected, the product list with ASINs, who makes each product, the importer of record, and any FDA registrations, test reports and English labels.

A few useful answers
Common questions
Does a Brazilian RC produtos policy cover my Amazon.com sales?
Only when the policy territory is extended to the United States in writing and the insurer can issue Amazon’s additional insured endorsement at a limit of at least $1 million. Check how it treats punitive damages as well, since a US court can award them.
Can a Brazilian Ltda. get US product liability through Mithril1?
It can, when an insurer accepts the catalog and Amazon.com sales after its review. We request the policy in the name of the company holding the Amazon.com account, whether that is the Brazilian company or a US subsidiary.
When does a Brazilian cosmetics brand need its US policy?
From November 2, 2026, cosmetics sit in Amazon’s enhanced-safety categories, so the $1 million policy applies at any sales level rather than from the $10,000 monthly trigger. Compare each ASIN with the category list in Seller Central.
Do I need RADAR before I can request US insurance?
The habilitação with Receita Federal is an export step, not an insurance one. We ask which company holds it because that tells the insurer who ships the goods.
Who is the named insured if a forwarder imports for me?
The company holding the Amazon.com account. The importer of record is a separate party; name it on the application, and the insurer decides how the policy treats it.
